The Company currently offers the following purchasable services:
- Social Basic
- Social Pro
- Custom Directory Landing Page Setup
Each service is subject to the specific terms, limitations, scheduling requirements, automation restrictions, content standards, and customer responsibilities described below.
The Company may modify, replace, discontinue, rename, expand, or reduce any service offering at any time. Any material change affecting an active paid service will apply prospectively unless an immediate change is reasonably necessary because of legal requirements, third-party platform requirements, technical limitations, security concerns, or circumstances beyond the Company’s reasonable control.
Social Basic
Service Description
The Social Basic service includes the preparation and automated publication of up to eight Facebook posts during each monthly service period.
Posts are ordinarily scheduled for publication on Wednesdays and Thursdays. The Company will generally attempt to distribute the eight monthly posts across the available Wednesdays and Thursdays occurring during the applicable monthly service period.
The precise posting dates, posting times, order of publication, content categories, images, captions, formatting, and scheduling intervals are determined by the Company and its automated publishing systems.
Monthly Posting Limit
The Social Basic service is limited to a maximum of eight Facebook posts during each monthly service period.
Unused posts do not roll over, accumulate, transfer, or create a credit toward a future month.
A monthly service period is determined according to the customer’s applicable billing cycle and may not correspond exactly with a calendar month.
The customer is not entitled to additional posts solely because a month contains additional Wednesdays or Thursdays.
Posts created, scheduled, processed, submitted, or attempted by the Company may count toward the monthly service limit even when publication is delayed, rejected, interrupted, duplicated, or otherwise affected by Facebook, Meta, Buffer, Make, Airtable, an application programming interface, an automation provider, or another third-party platform.
Standard Posting Schedule
Social Basic posts are ordinarily scheduled for Wednesdays and Thursdays.
The stated posting days represent the Company’s standard intended schedule and are not a guarantee that every post will be published on a particular date or at a particular time.
The Company may adjust posting times, skip a scheduled posting opportunity, move a post to another available time, or reschedule a post when reasonably necessary because of automation availability, platform restrictions, holidays, technical issues, account restrictions, content suitability, service interruptions, or other operational considerations.
The customer may not substitute different posting days, require exact publication times, or demand publication on a specific date unless the Company separately agrees to that request in writing.
Social Pro
Service Description
The Social Pro service includes the preparation and automated publication of up to twenty Facebook posts during each monthly service period.
Posts are ordinarily scheduled for publication Monday through Friday. The Company will generally attempt to distribute the twenty monthly posts across the available weekdays occurring during the applicable monthly service period.
The precise posting dates, posting times, order of publication, content categories, images, captions, formatting, and scheduling intervals are determined by the Company and its automated publishing systems.
Monthly Posting Limit
The Social Pro service is limited to a maximum of twenty Facebook posts during each monthly service period.
Unused posts do not roll over, accumulate, transfer, or create a credit toward a future month.
A monthly service period is determined according to the customer’s applicable billing cycle and may not correspond exactly with a calendar month.
The customer is not entitled to additional posts solely because a month contains more than twenty weekdays.
Posts created, scheduled, processed, submitted, or attempted by the Company may count toward the monthly service limit even when publication is delayed, rejected, interrupted, duplicated, or otherwise affected by Facebook, Meta, Buffer, Make, Airtable, an application programming interface, an automation provider, or another third-party platform.
Standard Posting Schedule
Social Pro posts are ordinarily scheduled Monday through Friday.
The stated posting days represent the Company’s standard intended schedule and are not a guarantee that a post will be published every weekday or at a particular time.
The Company may adjust posting times, skip a scheduled posting opportunity, move a post to another available time, or reschedule a post when reasonably necessary because of automation availability, platform restrictions, holidays, technical issues, account restrictions, content suitability, service interruptions, or other operational considerations.
The customer may not require exact publication times or demand publication on a specific date unless the Company separately agrees to that request in writing.
Terms Applicable to All Social Posting Services
No Customer Approval Process
Social Basic and Social Pro are standardized, managed-content services. They do not include a customer review, revision, editing, preapproval, or individual content-approval process.
The posts selected and prepared by the Company will be published in their completed form without being submitted to the customer for approval before publication.
By purchasing or continuing a social posting service, the customer expressly authorizes the Company to create, select, schedule, and publish posts without prior review or approval by the customer.
The customer acknowledges that the service is not a custom social-media management, copywriting, graphic-design, public-relations, brand-consulting, or advertising-agency engagement.
The customer may not reject an individual post, demand that a post be rewritten, require a replacement image, request a different topic, change the posting schedule, or require revisions as part of the standard service.
The Company may, but is not obligated to, consider general information provided by the customer about the customer’s business, location, services, target audience, or brand. Providing such information does not create a right of approval or require the Company to customize each post.
Post Removal Requests
A customer may notify the Company when the customer believes that a published post contains a material factual error, violates applicable law, improperly identifies the customer, or creates a legitimate reputational or safety concern.
The Company will review the request and may remove, correct, replace, or leave the post unchanged in its sole and reasonable discretion.
A customer’s personal dislike of a post, image, writing style, topic, phrasing, or creative approach does not automatically require removal, replacement, revision, credit, refund, or additional publication.
Removing a published post does not obligate the Company to create or publish a replacement post and does not reduce the number of posts counted toward the applicable monthly service limit.
Content Standards
The Company intends to avoid posts that are primarily political, sexually explicit, graphically violent, racially inflammatory, hateful, discriminatory, or otherwise unrelated to the ordinary scope of the service.
However, the customer acknowledges that content serving veterans, military families, military-connected organizations, and veteran communities may reasonably include references to military history, military branches, military culture, military service, war, combat, weapons, injuries, disability, loss, patriotism, government programs, veteran benefits, historical events, service-related experiences, or cultural subjects commonly understood within the veteran community.
Such references will not constitute prohibited political, violent, sexual, or racial content merely because the subject involves military service, war, government activity, national history, or the lived experiences of veterans.
The Company retains sole discretion to determine whether proposed content is appropriate for publication within the scope of the service.
The Company does not guarantee that every viewer, follower, customer, veteran, political group, advocacy group, social-media platform, or member of the public will agree with, approve of, or avoid taking offense at published content.
No Political Advocacy
The Company will not intentionally create posts whose primary purpose is to endorse or oppose a political candidate, political party, election campaign, ballot initiative, or partisan political organization.
References to legislation, government agencies, veteran programs, military history, public policy, veteran benefits, healthcare systems, or governmental decisions do not automatically constitute political advocacy.
Customer Content and Information
The customer is responsible for ensuring that all names, business information, contact details, photographs, logos, trademarks, service descriptions, licensing information, credentials, claims, and other materials provided to the Company are accurate, lawful, current, and authorized for use.
The customer grants the Company a non-exclusive, worldwide, royalty-free license to use, reproduce, resize, crop, format, modify, publish, distribute, and display customer-provided materials solely as reasonably necessary to perform the purchased services.
The customer represents and warrants that the customer owns or has obtained all rights, licenses, permissions, releases, and authorizations necessary for the Company to use any materials supplied by the customer.
The Company is not responsible for investigating ownership, copyright, trademark, privacy, publicity, licensing, or other legal rights associated with customer-provided materials.
The customer agrees to defend, indemnify, and hold the Company harmless from claims arising from materials, information, instructions, representations, or content provided by the customer.
Facebook Page Access
The customer must provide and maintain all permissions, credentials, account connections, administrative access, authorizations, tokens, integrations, and third-party approvals reasonably necessary for the Company’s automation systems to publish to the customer’s Facebook page.
The customer is responsible for ensuring that the Facebook page remains active, accessible, eligible for posting, and in compliance with Meta’s rules and policies.
The Company is not responsible for missed, delayed, rejected, or failed posts caused by:
- Expired or revoked permissions;
- Disconnected accounts;
- Changed passwords;
- Removed administrative access;
- Expired access tokens;
- Page restrictions;
- Account suspensions;
- Facebook or Meta policy violations;
- Customer changes to account settings;
- Failure by the customer to complete a required authorization;
- Third-party security or authentication requirements; or
- Any action or omission by the customer, Facebook, Meta, or another third party.
The customer must promptly notify the Company of any change that may affect publishing access.
Automated Publishing
The customer acknowledges that Social Basic and Social Pro rely substantially on automated systems and third-party platforms.
These systems may include Facebook, Meta, Buffer, Make, Airtable, hosting services, application programming interfaces, databases, scheduling tools, cloud-service providers, internet-service providers, authentication providers, and other software or technology selected by the Company.
Automated publishing systems may occasionally experience outages, delays, processing errors, duplicated requests, failed requests, incorrect scheduling, expired connections, platform rejections, lost data, rate limits, service interruptions, software defects, or other unexpected behavior.
The Company does not warrant that automated systems will operate continuously, securely, accurately, or without interruption or error.
Missed or Failed Posts
When a scheduled post is missed because of an automation error, software error, service interruption, expired connection, third-party platform failure, or another technical problem, the original scheduled posting opportunity may be skipped.
The Company may make a reasonable attempt to publish the affected post again after the Company becomes aware of the issue and determines that republication is operationally practical.
A republication attempt is not guaranteed to occur on the same day, at the same time, or during the same monthly service period as the original scheduled post.
The Company is not required to manually publish a missed post, repeatedly attempt publication, provide an additional replacement post, extend the service period, carry the post into a later month, issue a refund, or provide an account credit.
A post will not be considered missed solely because it publishes later than expected, publishes at a different time, appears differently on different devices, receives limited distribution, receives no engagement, or is not shown by Facebook to a particular user.
Duplicate or Delayed Posts
Automation errors may occasionally cause a post to be delayed, duplicated, reordered, or published at an unintended time.
The Company may remove or correct a duplicate post after becoming aware of it but is not obligated to monitor every Facebook page continuously or identify every automation error immediately.
A duplicated, delayed, reordered, or incorrectly timed post does not create an automatic right to a refund, credit, replacement post, or other compensation.
No Guarantee of Reach or Results
The Company does not guarantee any minimum level of:
- Followers;
- Page likes;
- Post reach;
- Impressions;
- Engagement;
- Comments;
- Shares;
- Messages;
- Leads;
- Appointments;
- Sales;
- Revenue;
- Search-engine visibility;
- Brand recognition; or
- Business growth.
Facebook and Meta independently control content distribution, account visibility, platform algorithms, audience delivery, moderation, advertising rules, and user access.
The Company has no control over Facebook’s algorithm or the manner in which Facebook displays, limits, suppresses, removes, labels, reviews, or distributes a post.
Past performance, examples, screenshots, testimonials, or results experienced by another customer do not guarantee similar results.
No Paid Advertising Included
Unless expressly stated otherwise in a separate written agreement, Social Basic and Social Pro include organic Facebook posting only.
The services do not include paid advertising, boosted posts, advertising spend, campaign management, audience targeting, retargeting, lead forms, advertising-account administration, conversion tracking, or payment of any Facebook or Meta advertising charges.
No Comment or Message Management
Unless expressly stated otherwise in a separate written agreement, the social posting services do not include:
- Responding to comments;
- Responding to reviews;
- Monitoring direct messages;
- Answering customer questions;
- Moderating discussions;
- Removing comments;
- Handling complaints;
- Managing leads;
- Scheduling appointments; or
- Providing customer service on the customer’s behalf.
The customer remains solely responsible for monitoring the Facebook page and responding to users, leads, customers, patients, veterans, or members of the public.
No Exclusivity
The social posting services are non-exclusive.
The Company may provide similar posts, topics, formats, concepts, images, templates, writing styles, schedules, or services to other customers, including customers operating in the same profession, industry, state, region, or market.
The customer does not acquire exclusive ownership of general content ideas, post structures, templates, layouts, concepts, prompts, themes, or production methods used by the Company.
Custom Directory Landing Page Setup
Service Description
The Custom Directory Landing Page Setup is a one-time setup service through which the Company creates or activates a directory landing page for the customer using a Company-controlled template.
The service includes initial configuration of the landing page and placement of the customer’s permitted personal, professional, practice, location, contact, or directory information into the designated editable fields supported by the selected template.
The service is a template-based directory service and is not a custom website-design, custom software-development, search-engine-optimization, branding, copywriting, hosting, or unrestricted webpage-development service.
One-Time Setup
The Custom Directory Landing Page Setup fee covers one initial setup of one landing page unless the applicable offer expressly states otherwise.
The setup fee does not include recurring redesign, unlimited revisions, ongoing development, custom programming, custom layouts, additional pages, migration to another website, or transfer of the underlying template or technology.
Any work requested outside the stated scope may be declined or may require a separate written agreement and additional payment.
Template-Based Design
The landing page will be created from a template selected and controlled by the Company.
The customer does not have the right to modify, rearrange, redesign, duplicate, export, download, copy, sublicense, reverse engineer, or obtain access to the underlying template, source code, database structure, page-builder configuration, design system, automation, or proprietary technology.
The customer acknowledges that other directory participants may use the same or a substantially similar template.
The Company may update, improve, replace, reorganize, or discontinue a template when reasonably necessary to maintain the directory, correct technical problems, satisfy legal requirements, improve compatibility, or support future development.
Editable Information
The landing page is not independently editable by the customer except for personal or professional information fields that the Company specifically makes available for customer editing.
Editable fields may include items such as:
- Practice name;
- Provider name;
- Professional title;
- Business address;
- Telephone number;
- Email address;
- Website address;
- Office hours;
- Service categories;
- Practice details;
- Biography information;
- Photographs;
- Logos; and
- Other directory fields made available by the Company.
The existence, availability, labels, character limits, formatting, validation requirements, and display of editable fields are determined solely by the Company.
The customer may not demand access to fields, sections, layouts, features, integrations, or design controls that are not included in the purchased service level.
Customer Information
The customer is solely responsible for providing accurate, complete, lawful, current, and properly formatted information for the landing page.
The customer must promptly correct any inaccurate or outdated information through the available account fields or by notifying the Company when a field is not customer-editable.
The Company may rely on information provided by the customer without independently verifying the accuracy of that information.
The Company may refuse, edit, shorten, format, remove, or decline to publish information that:
- Is inaccurate or misleading;
- Cannot reasonably be verified;
- Exceeds field limits;
- Does not fit the directory format;
- Violates applicable law;
- Violates a third party’s rights;
- Creates a security concern;
- Contains prohibited claims;
- Could mislead veterans or consumers; or
- Is otherwise inappropriate for the directory.
No Unauthorized Modification
The customer may not use scripts, browser tools, plugins, application programming interfaces, automated requests, scraping tools, unauthorized credentials, reverse engineering, code injection, or any other method to alter or interfere with the landing page outside the authorized personal-information fields.
Any unauthorized attempt to modify the landing page, access restricted functions, copy proprietary components, or interfere with the directory may result in immediate suspension or termination without refund.
Future Templates
The Company may develop and release additional landing-page templates in the future but is under no obligation to do so.
The release date, availability, features, design, eligibility requirements, pricing, and service levels associated with future templates are determined solely by the Company.
When additional templates become available, the customer may receive access to templates included within the customer’s then-current purchased service level.
Access to a future template is not guaranteed merely because the customer previously purchased a landing-page setup.
A future template may require:
- An active account;
- An active directory subscription;
- A particular listing level;
- A particular landing-page package;
- Payment of an upgrade fee;
- Payment of a new setup fee;
- Acceptance of updated terms; or
- Compliance with additional technical or content requirements.
Template Upgrades
If a more advanced template becomes available at a higher service level, the customer may be permitted to upgrade by paying the applicable price difference, setup fee, subscription increase, or other charge established by the Company.
An upgrade does not necessarily include migration of all existing content, custom modification of the new template, preservation of every prior design element, or access to features not included with the upgraded level.
The Company will determine the upgrade process, migration method, eligibility requirements, implementation schedule, and available features.
No Guaranteed Continued Availability
The Company does not guarantee that a specific template, layout, feature, integration, design, field, or directory function will remain available indefinitely.
The Company may alter or discontinue a template or feature because of technical requirements, security concerns, third-party software changes, legal requirements, directory restructuring, maintenance needs, platform limitations, or business considerations.
When reasonably practical, the Company may move an affected landing page to a comparable available template. Exact reproduction of the prior design or functionality is not guaranteed.
Directory Hosting and Control
The landing page remains part of the Company’s directory and is hosted, maintained, and controlled by the Company or its service providers.
The purchase of a landing-page setup does not transfer ownership of:
- The directory;
- The domain name;
- The landing-page URL;
- The template;
- The website design;
- The page-builder configuration;
- The hosting account;
- The underlying code;
- The database;
- The directory software;
- The automation systems; or
- Any Company intellectual property.
The customer retains ownership of original customer-provided content, subject to the licenses granted to the Company under this Agreement.
No Guarantee of Traffic or Business Results
The Company does not guarantee that the landing page will achieve any particular search-engine ranking, website traffic, visitor count, inquiry volume, appointment volume, lead volume, referral volume, revenue, visibility, or business result.
Search engines, third-party platforms, users, government agencies, referral sources, and other outside parties independently control their own systems and decisions.
Search-Engine Changes
The customer acknowledges that search engines may index, rank, display, omit, modify, or remove landing pages according to their own algorithms and policies.
The Company is not responsible for changes in search-engine rankings, indexing status, search-result appearance, algorithm updates, penalties, deindexing, reduced traffic, or actions taken by a search-engine provider.
Suspension or Removal
The Company may suspend, restrict, unpublish, or remove a landing page when:
- The customer provides false, misleading, or outdated information;
- The customer violates this Agreement;
- The customer fails to pay an applicable recurring directory or hosting charge;
- The customer is no longer eligible for the applicable directory category;
- The customer loses a required professional license or authorization;
- The customer misuses Company intellectual property;
- The page creates a legal, security, technical, or reputational risk;
- A government agency, court, platform, hosting provider, or third party requires or requests removal;
- The directory or applicable service is discontinued; or
- Removal is otherwise reasonably necessary to protect the Company, veterans, consumers, participating providers, or third parties.
Third-Party Platforms and Services
The services may depend upon third-party platforms, software, hosting providers, application programming interfaces, social-media networks, automation tools, database services, payment processors, internet providers, and other outside services.
The Company does not own or control these third parties and is not responsible for their:
- Availability;
- Security;
- Reliability;
- Performance;
- Policies;
- Pricing;
- Terms;
- Algorithms;
- Errors;
- Outages;
- Data loss;
- Account restrictions;
- Service changes; or
- Discontinuation.
A third-party change may affect the Company’s ability to perform a service as originally intended. The Company may modify the service, substitute another provider, change the delivery process, suspend affected functions, or discontinue a feature when reasonably necessary because of a third-party change.
Force Majeure and Events Beyond the Company’s Control
The Company will not be liable for any delay, interruption, failure, omission, missed post, lost data, reduced functionality, inability to perform, or other consequence caused directly or indirectly by an event beyond the Company’s reasonable control.
Events beyond the Company’s reasonable control include, without limitation:
- Acts of God;
- Natural disasters;
- Fire;
- Flood;
- Earthquake;
- Severe weather;
- Epidemic or pandemic;
- War;
- Terrorism;
- Civil unrest;
- Government action;
- Changes in law or regulation;
- Labor disputes;
- Utility failures;
- Internet outages;
- Telecommunications failures;
- Cyberattacks;
- Malware;
- Security incidents;
- Hosting outages;
- Cloud-service outages;
- Software defects;
- Automation errors;
- Application programming interface failures;
- Third-party platform changes;
- Facebook or Meta outages;
- Buffer, Make, or Airtable outages;
- Account restrictions imposed by a third party;
- Failures by contractors or service providers;
- Loss of required third-party access;
- Equipment failure;
- Database corruption;
- DNS failures;
- Payment-processor interruptions; or
- Any similar event outside the Company’s reasonable control.
During such an event, the Company’s obligations will be suspended to the extent and for the duration that performance is prevented, delayed, or made commercially impractical.
The Company may resume, modify, substitute, or discontinue the affected service after the event without liability for the interruption.
Service Credits and Refunds
Except where required by applicable law or expressly stated in a separate written refund policy, fees for completed setup work, prepared content, scheduled content, attempted publications, digital services, and monthly service periods are nonrefundable.
A missed, delayed, duplicated, rejected, reordered, or failed social-media post does not automatically entitle the customer to a refund, partial refund, service credit, extended service period, replacement content, or monetary damages.
A temporary interruption or modification of a landing page does not automatically entitle the customer to a refund or service credit.
The Company may voluntarily provide a replacement publication, correction, extension, or credit in its sole discretion. A voluntary accommodation does not create a continuing obligation or establish a precedent for future circumstances.
Limitation of Liability for Purchased Services
To the maximum extent permitted by applicable law, the Company will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to the purchased services.
This limitation includes alleged damages arising from:
- Missed or failed posts;
- Delayed publication;
- Duplicate publication;
- Reduced social-media reach;
- Loss of followers;
- Negative comments or public reactions;
- Loss of business opportunities;
- Loss of revenue or profits;
- Loss of prospective customers;
- Loss of search-engine rankings;
- Loss of website traffic;
- Third-party platform restrictions;
- Account suspension;
- Automation failures;
- Data loss;
- Template changes;
- Directory interruptions;
- Customer-provided inaccuracies; or
- Events outside the Company’s reasonable control.
To the maximum extent permitted by applicable law, the Company’s total aggregate liability arising from a particular purchased service will not exceed the amount actually paid by the customer to the Company for that specific service during the three months immediately preceding the event giving rise to the claim.
For a one-time Custom Directory Landing Page Setup claim, the Company’s maximum aggregate liability will not exceed the amount actually paid for the applicable one-time setup.
Customer Indemnification
The customer agrees to defend, indemnify, and hold harmless the Company and its owners, officers, employees, contractors, service providers, affiliates, licensors, and agents from claims, demands, actions, losses, liabilities, damages, judgments, penalties, fines, settlements, costs, and expenses, including reasonable attorneys’ fees, arising from or relating to:
- Information or materials supplied by the customer;
- The customer’s business, services, representations, or conduct;
- The customer’s violation of applicable law;
- The customer’s violation of a third party’s rights;
- Copyright, trademark, privacy, publicity, licensing, or ownership claims involving customer-provided materials;
- False, inaccurate, misleading, or outdated customer information;
- Medical, professional, benefit, eligibility, or service claims made by the customer;
- The customer’s Facebook page or social-media account;
- The customer’s failure to maintain required permissions or account access;
- The customer’s unauthorized modification or misuse of a landing page; or
- The customer’s breach of this Agreement.
Modification of Service Terms
The Company may update these service descriptions, limitations, posting schedules, content standards, technical requirements, available templates, service levels, or operational procedures from time to time.
Changes may be necessary because of new services, platform changes, automation requirements, technical limitations, legal obligations, security concerns, or business needs.
Continued use or renewal of a service after updated terms become effective constitutes acceptance of the updated terms.
